OpenWeb and its Affiliates Quality Guidelines
Introduction:
OpenWeb Technologies Ltd. and its affiliates (collectively, "OpenWeb") are dedicated to maintaining high-quality inventory to protect buyers, sellers and third parties. These Quality Guidelines ("Guidelines") serve to guide both supply and demand partners (collectively, "Partners") participating in our services. Our policies govern how advertising (or “Ads”) is displayed across the various digital properties ("Properties"), requiring all Partners to meet high industry and ethical standards, and comply with applicable laws and regulations. We reserve the right to accept, decline, or remove any media that doesn't meet these Guidelines at our discretion.
- Prohibited Content: Supply partners will refrain from displaying on their Properties, and demand partners will abstain from providing Ads that explicitly or implicitly engage in any of the following content:
- Adult content, such as nudity/overly suggestive content; promoting adult products or services; escort services; pornography, etc.
- Hate speech and defamatory language, such as hatred and discrimination of an individual or group on the bases of race, ethnic origin, etc.; harassment; threats or advocation of harm; exploitation, harmful spread of disinformation, etc.
- Violence, obscenity, and profanity, such as thesale and instructions for creating weapons, ammunition, and the likes of; violent language or content; advocacy of death or injury; obscene and profane language; cruelty towards animals; military aggression, war crimes and terrorism, etc.
- Illegal drugs, such aspromoting, selling, and soliciting the use of illegal drugs.
- Online piracy and intellectual property violations, such as pirating; copyright infringements; counterfeiting, etc.
- Tobacco, e-Cigarettes and vaping, such as promotion and advocacy to minors or the sale of such products. Any other content that OpenWeb, at its sole discretion, finds to be inconsistent with the values of its services.
- Ad Placement: Supply partners shall adhere to the following guidelines when displaying and placing ad inventory on their Properties. Demand partners shall not use, link to, or promote any Ads or landing pages, engaging in any of the following, as applicable:
- Properties and Ads will not initiate pop-ups, pop-under or automatic redirects.
- All pages must host content offering value for the reader and have functioning navigation.
- Ads will be clearly distinguishable from other content.
- Ads shall not be positioned in areas where users are likely to inadvertently click or interact with them (for example, near buttons or areas prone to accidental clicks or touches).
- “X” buttons must be operational and functional at all times.
- The number of Ads, layout, format, and refresh rate must remain consistent regardless of the entry point of a reader on a page or within content.
- Ads shall not be "stacked" in any manner, hidden behind other content, rendered invisible by placing them in small iframes, or programmed to prevent their actual appearance.
- Properties or Ads that present content in a slideshow format (i.e., a format that requires users to advance through the content by clicking on an image, icon, or link) shall be subject to the following restrictions:
- Each slideshow shall contain a maximum of three (3) ad units, positioned at or above the end of the slideshow content. In mobile Properties, a single Ad may also appear immediately below the slideshow content.
- Slideshows will only load new Ads when initiated by a user's click.
- Slides must differ materially from each other in content.
- Auto-refresh of webpages or Ads is prohibited.
- Prohibited Functions: Supply partners will not incorporate or permit any of the following functions to be part of any of the Properties. Demand Partners will not engage in or encourage any activity that results in any of the following functions:
- Do not redirect users to unexpected, misleading, or malicious websites.
- Do not distribute or install viruses, malware, or similar malicious code.
- Supply partners are prohibited from editing, modifying, resizing, or otherwise changing ads.
- Properties or Ads will not include fake error messages or system flags.
- Ads will not include adware, toolbar, or any other undesirable functionality.
- Promoting Fair and Legal Conduct: Partners shall ensure that any interaction with our services complies with all applicable laws and regulations within their respective spheres of responsibility. This includes adhering to the following guidelines:
- Partners must fully comply with industry standards and practices, including standards and terms set by advertising networks, affiliate networks, anti-virus and security guidelines, search engines, and browsers.
- Demand partners shall not make the following content available, nor shall it be used on any supply partners' properties, without meeting the specific guidelines relevant to the respective fields to which this content pertains. Partners are responsible for ensuring that any such advertising complies with the relevant industry's code of conduct and regulatory requirements:
- Medical, pharmaceutical, health & beauty: content must only be available in permitted locations. Prohibited products or ingredients shall not be included.
- Alcohol: Sale or promotion of alcoholic products must comply with legal restrictions, including age restrictions, required disclosures, prohibition of false claims regarding social status, advocacy of excessive drinking, and association of alcohol consumption with driving or operating heavy machinery.
- Cannabis, CBD, THC
- Political content
- Gambling & gaming: This includes geo-restricting or age-restricting such advertising in relevant jurisdictions.
- Any collection of Personal Data (or "Personal Information," as defined under applicable privacy laws) must comply with regulatory requirements. This includes furnishing end users with a privacy policy that meets the requirements of all applicable laws and is easily accessible for review by any end user before any Personal Data is collected. Such privacy policy must clearly and accurately describe the information collected, used, or shared with third parties (including OpenWeb and any potential Partners), the methods and purposes of collection, and the types of recipients of any collected information. Additionally, any use of tracking technologies by Partners should require affirmative consent from the end user in all applicable jurisdictions. Personal Data shall only be collected and shared by Partners based on end user consent or other lawful grounds established by Partners, as applicable.
- Unless explicitly approved by OpenWeb in writing, Partners will not target or transmit any Personal Data of minors, as defined by relevant laws in each jurisdiction. It is the responsibility of the Partners to strictly adhere to industry standards and policies that uphold the rights and ensure the safety of minors.
- Any and all impressions must be generated solely by human activity. Consequently, the following actions are strictly prohibited:
- Using any types of automated means to generate impressions, including but not limited to scripts, spiders, crawlers, bots, or the employing of actual persons for the purpose of manually interacting with Ads (e.g. by clicking, viewing, downloading etc.).
- "Hijacking" devices or browsers.
- Any other means, actions, or methods intended to produce inaccurate, artificial, or false numbers related to clicks, impressions, or any other relevant measurable actions.
These Guidelines are intended to provide a framework for compliance with industry standards and regulatory requirements related to content, Ad format, and Ad placement within OpenWeb's services. They do not limit OpenWeb in enforcing additional requirements necessary to maintain a safe, fair, and legally compliant service. OpenWeb reserves the right to amend and update these Guidelines as needed to align with evolving regulatory and industry standards. OpenWeb also retains the right to take action against any Partner found to be infringing upon these Guidelines, including but not limited to cooperation with regulatory authorities, disabling of accounts, and undertaking any other necessary actions deemed appropriate.
